The Supreme Court has dismissed the Centre's curative petition seeking a recall of its verdict giving police the liberty to probe the role of armed forces in alleged encounter cases in areas where AFSPA is in force. "The prayer for hearing the curative petition in open court is rejected," a bench headed by Chief Justice J S Khehar said in its order passed yesterday during in-chamber proceedings in which lawyers do not participate. "We have gone through the curative petition and the relevant documents. In our opinion, no case is made out within the parameters indicated in the decision of this court... Hence, the curative petition is dismissed," the bench, also comprising Justices Dipak Misra, J Chelameswar, Madan B Lokur and U U Lalit, said. A day after it was rapped by the Supreme Court for remaining silent over rape and murder charges against its personnel in Manipur, the Army today said the judicial probes conducted into these charges were "biased" and slanted against them due to local factors. It alleged that the district judges, who were locals, had conducted the judicial inquiries into the alleged killings and local factors came in the way of the probe reports which went against the armed forces. "The problem in every case is that the slant of judicial inquiry was against us. Judicial inquiries which have been done by a district judge proceeded against us by the virtue of their local apprehensions or local positions. Armys job is not to kill its own people," Attorney General Mukul Rohatgi told a bench of Justices M B Lokur and U U Lalit. Only an independent investigation by a Special Investigation Team (SIT) will lend credibility to the proceedings in the "extra-judicial killings by the security forces" in Manipur, said a report filed by Amicus Curiae Menaka Guruswamy to the Supreme Court on Tuesday. Making a strong case for a trial by a special court constituted by the SC, it pointed out the "delayed justice" and "gross misuse" of the Armed Forces Special Powers Act (AFSPA) in the state. Guruswamy's report is highly significant because, if implemented, it will be the first time that senior police officers will investigate excesses of the armed forces in any part of the country. Guruswamy's report, compiled from the proceedings of 265 cases of extra-judicial killings in Manipur, looked at evidence from high court judgments, judicial inquiries, and NHRC reports, noting that monetary compensation in several cases signified the state's apathy and ensured that the killings continued unabated.
