Right from the beginning, the Machil fake encounter case has beaten a path different from that of several other similar cases in Jammu and Kashmir where civilians were found to have been killed by State forces in cold blood. As with the 2010 deaths of the three youths in Machil, Kupwara, under the guise of a counter-insurgency operation, there have been public protests after the killings. There have also been times when the political leadership has promised justice and civilian courts have found concrete evidence to refute armymen's claims that they had exterminated militants, and not unsuspecting civilians. So, these were not unique to the Machil case. What changed the trajectory of this case was that the army's court of inquiry came to the same conclusion as that of the police, which had pieced together evidence that showed army officers and soldiers had colluded to kill three innocent men and then claim rewards for their deed. Over four years after the Machil fake encounter that fuelled widespread unrest in Kashmir Valley, five army men including two officers were sentenced to life for gunning down three youths and labelling them as militants, a decision welcomed by Jammu and Kashmir Chief Minister Omar Abdullah today as a "watershed moment". Official sources said that the five army men including the then Col D K Pathania, who was the Commanding Officer, and Captain Upendera were held guilty by the Summary General Court Martial (SGCM) which sentenced them to life imprisonment. The others held guilty were Havaldar Devinder, Lance Naik Lakhmi and Lance Naik Arun Kumar. Another accused, a Subedar, has been let off by the SGCM.
