The Union home ministry and CBI are heading for a standoff as the ministry is unlikely to grant sanction to the probe agency to prosecute four Intelligence Bureau officials, including its former special director Rajinder Kumar, in the Ishrat Jahan fake encounter killing case. Sources said the probe agency has not yet submitted the case documents for examination as sought by the ministry which has asked the CBI for certain documents. MHA sources said examination of the material available was necessary before taking any decision on granting sanction. “No sanction will be accorded without proper application of mind for which material available on record is required. Since the CBI has not yet shared the case diary, we are not in a position to take any decision,” an official said. A fresh tussle seems to be in the offing between the ministry of home affairs (MHA) and the CBI with the latter expressing its reservation over the issue of sharing its “case diary” pertaining to the Ishrat Jahan alleged fake encounter case, involving former Intelligence Bureau (IB) officials, as required by the ministry. The agency has now sought legal opinion over the issue amidst the possibility that the move will further delay CBI’s decision to prosecute IB officials in the case. Sources in the CBI said, “CBI’s contention is that sharing the case diary with the MHA would be against the basic principles of the Criminal Procedure Code (CrPC). A Delhi court Monday awarded life imprisonment to 17 of the 18 policemen convicted of killing a 22-year-old MBA student in a fake shootout in Dehradun in 2009. Central Bureau of Investigation (CBI) Special Judge J.P.S. Malik awarded life terms to 17 policemen involved in the fake gun battle. The court Friday convicted 18 policemen for the cold blooded murder of the youth, but acquitted one of them of the murder charge while convicting him for falsifying records. Jaspal Singh Gosain, the head operator at city control room, was convicted under Section 218 of the Indian Penal Code (IPC) (public servant framing incorrect record). The 18 policemen were charge sheeted by the CBI in connection with the Ranbir Singh case that rocked the hill state in July 2009.
