The order of the High Court of Karnataka banning commercial buildings in "residential main area" is flagrantly violated along the 10th Main Water Tank Road and surrounding areas in Indiranagar. Several commercial buildings dot this road, classified as "residential main zone" in the comprehensive development plan of the Bangalore Development Authority. The ward engineers of the Bruhat Bengaluru Mahanagara Palike (BBMP), in reply to RTI queries by residents, admit that these buildings not only violate zoning regulations, but also lack trade licences. Yet, these buildings are intact and do brisk business. "Imagine a situation where 60-70 people are in an office adjacent to a residential building. Opening the windows of our house would mean that we are constantly under the gaze of these strangers. The residents of HAL 2nd Stage will take to the streets on Saturday to protest against what they call unchecked commercialisation of their area. Having grown weary of the noise from the pubs and bars, garbage dumping, overflowing sewage and illegal parking, the residents will protest at 12th Main, HAL II Stage at 8 pm on Saturday. Aruna Newton, president of the HAL 2nd Stage Residents' Welfare Association (RWA) said that they had approached the Bruhat Bengaluru Mahanagara Palike (BBMP) authorities in the past, but to no avail. They filed more than 280 Right To Information (RTI) applications with the BBMP and the Bangalore Development Aurthority (BDA)to get information on the trade licences and permissions that the individual establishments had obtained. The government has handed over the departmental enquiry against five BBMP engineers to the Upalokayukta. The engineers have been charged with failing to clear encroachment on the rajakaluve (storm-water drain-SWD) at Mahadevapura. The Upalokayukta had earlier submitted a report, recommending departmental enquiry against them. Officials facing enquiry are Mallinath Malkapur, assistant engineer, Mahadevapura; Bhagyamma, assistant executive engineer at HAL sub-division; Raghavendra, assistant engineer; Pandurangaiah, assistant executive engineer and Malathi, executive engineer. The last three were in the SWD wing of Bruhat Bengaluru Mahanagara Palike. The enquiry was based on a complaint by RTI activist Saidatta. The complaint said two builders, B V S Reddy and Ashwathanarayana, had constructed a residential building, Mytri Apartments, in Mahadevapura, covering 66 feet of the SWD. An official has been fined a staggering Rs 2.29 lakh for failing to give information under the Right To Information (RTI)Act in 24 separate instances. He paid Rs 1.45 lakh of the fine but still refused to furnish information. Taking strong exception to the official's continued misdemeanour, the Karnataka Information Commission (KIC)has ordered disciplinary action against him under Section 22 of the RTI Act. The official in question is D Hemanth (in pic). He has been repeatedly trying to outwit the commission, which has been hearing cases against him from 2009 onwards. In all these years, he did not appear before the commission even once. Trouble started when Hemanth was posted on a deputation to the Bruhat Bengaluru Mahanagara Palike (BBMP) as Assistant Executive Engineer (Cottonpet). The city police have registered a case against an RTI activist and a journalist for extorting money from three BBMP engineers. The duo had applied 120 times under the RTIAct seeking details of two projects taken up by the BBMP. They accused the engineers of committing irregularities and extorted Rs 50,000 from them. Based on a complaint, the Banaswadi police have registered a case under the IPCSections 384 (extortion) and 34 (an act done in common intention) against the duo. The suspects are Mahesh P, a resident of Jyothinagar on Hennur Main Road and RRamesh, a journalist with a private TVchannel and a resident of Nehrunagar in Kammanahalli. The two have obtained anticipatory bail, the police said.
