Quota-based promotions: state files review petition in SC 26.4.2017 Deccan Herald - State
The Karnataka government on Wednesday filed a review petition in the Supreme Court against the February 9 judgement that had set aside the state law granting reservation in promotion to SC/ST employees as ultra vires of the Constitution.

The petition was filed after seeking opinion from Attorney General, sources said. A bench of Justices Adarsh K Goel and U U Lalit would consider the plea for reconsideration of the judgement in their chambers as mandated under the SC rules. As many as two batches of such review petitions have already been filed in the matter.

In its judgement, the apex court had then said that the exercise granting benefits to the officers by the state government under the 2002 law, was undertaken without determining 'inadequacy of representation', 'backwardness' and 'overall efficiency'. The judgement has triggered fear of demotion in their ranks among the employees.

About 400 Karnataka government officers on Monday urged the Supreme Court to reconsider its February 9 judgement that had declared as unconstitutional the state law granting reservation in promotion to SC/ST employees. Meanwhile, the Karnataka government is also likely to file its review petition against the verdict during the course of the week. Attorney General Mukul Rohatgi has been consulted in drafting the petition, sources said. The officers, working in different departments such as Health, Education, Agriculture and Revenue, were not party to the case. But now they fear demotion. They maintained that the power lies with the state to make provision for consequential seniority in promotion as per Article 16(4A) (reservation in promotion) of the Constitution. The Supreme Court on Friday declined to entertain a bunch of petitions challenging the Karnataka rules pertaining to the reservation of the posts of president and vice president of zilla panchayats (ZPs) in the state. A bench of Justices J Chelameswar and S Abdul Nazeer dismissed the plea made by Janata Dal (S) leader Latha and others.
